Terms and Conditions

Welcome to Gumoreh. These Terms and Conditions ("Terms") govern your use of the Gumoreh mobile application, website, and related services (collectively, the "Service") provided by Gumoreh ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required in your country to use a social service, to use Gumoreh. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your account

• You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
• You are responsible for all activity that happens under your account. Notify us immediately at support@gumoreh.com if you suspect unauthorized access.
• You may not impersonate another person, use another person's phone number without consent, or create an account to circumvent a previous suspension or ban.

3. Your content

You retain ownership of the vibes, photos, captions, comments, places, and messages you create or submit ("Your Content"). By posting Your Content on Gumoreh, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for example, to resize or re-encode), distribute, and display Your Content solely for the purpose of operating, providing, and improving the Service.

You represent and warrant that you have all rights necessary to grant this license and that Your Content does not violate any third-party rights or applicable law.

4. Acceptable use

When using Gumoreh, you agree not to:

• Post content that is illegal, harassing, threatening, discriminatory, sexually explicit, or that exploits minors.
• Post content that infringes copyright, trademark, privacy, publicity, or other rights.
• Spam, scrape, scrape-and-resell, or otherwise abuse the Service, including attempting to circumvent rate limits, security measures, or access controls.
• Upload malware, attempt to probe vulnerabilities, interfere with other users' accounts, or reverse engineer the Service beyond what is permitted by applicable law.
• Use the Service to stalk, dox, or surveil others.
• Misrepresent places — for example, by registering a venue you do not operate and do not have authorization to register.

5. Moderation and enforcement

We may review content and accounts and, at our sole discretion, remove content, limit features, or suspend or terminate accounts that violate these Terms or that we believe present a risk to users, the Service, or third parties. We may also cooperate with law enforcement where required or appropriate.

6. Intellectual property

The Service — including the Gumoreh name, logo, app design, software, and underlying technology — is owned by Gumoreh and protected by intellectual property laws. Except for the rights expressly granted in these Terms, we reserve all rights in and to the Service.

7. Third-party services

The Service may link to or rely on third-party services (for example, maps, authentication, payments, or notification providers). We are not responsible for the availability, content, or practices of third-party services. Your use of a third-party service is governed by that service's own terms and privacy policy.

8. Place ownership and paid features

Place owners may claim a venue and subscribe to paid plans through the Gumoreh app. Paid features (for example, the Pro plan) are billed via our payment processor (Razorpay). You authorize us and the processor to charge your selected payment method on the cadence shown at checkout. Refunds are governed by the policy displayed at purchase. Misrepresenting authorization to claim a venue is a material breach of these Terms.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy of place information, popularity indicators, or user-submitted content.

10. Limitation of liability

To the maximum extent permitted by applicable law, Gumoreh and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you have paid us in the past twelve (12) months, if any, or (b) one hundred US dollars (US$100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Gumoreh and its affiliates from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms.

12. Termination

You may stop using the Service at any time. You may request account deletion from Settings → Delete account in the app or by emailing support@gumoreh.com. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or pose a risk to users or the Service.

13. Changes to the Service or these Terms

We may modify the Service at any time — adding, changing, or removing features. We may also update these Terms. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice in the app. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Gumoreh is established, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located there for any dispute arising out of or relating to these Terms, except where mandatory local law provides otherwise.
